The purpose of copyright is to protect the creator (author) and his or her work. Copyright is intended to ensure that the author of a work is remunerated when third parties use his or her works (e.g. images, texts, music or even an interpretation). An author has the copyright and the right to exploit his or her work.

 

Difference between exploitation right and right of use
The exploitation right is the author's exclusive right to distribute, reproduce or publicly communicate his or her work. The right of exploitation also includes the right of communication to the public (lecture, performance and presentation right) etc.

 

A right of use entitles the holder of the right of use to use a work in the permitted manner. A simple right of use does not exclude use by other authorised users. This would require an exclusive right of use. A right of use may be limited in terms of space, time or content.

 

The copyright and the right of exploitation in a work are not transferable; they belong to the author (creator). However, the holder of the copyright and the right of exploitation may grant a right of use in a work. The right of use granted is the right of a third party.

 

Linguistic works

Linguistic works can not only be written works (fiction, poetry, screenplays, song lyrics, scientific texts, instructions for use), but also have oral forms such as speeches, lectures or even interpreting services.

 

The speaker at an international event is the creator of his speech (a linguistic work). The interpretation is considered an adaptation of this linguistic work and thus a personal intellectual creation of the interpreter. Therefore, the interpreter is entitled to the copyright and exploitation rights to the interpretation. If use of the interpretation is desired, the interpreter must grant a corresponding right of use (licence).

 

Possible uses of an interpretation

In practice, two types of use of an interpretation are common, which are sometimes combined:

 

• Recording: The reasons for recording an interpretation can be manifold - be it to publish the interpretation later (e.g. on one's own website) or to use it on the intranet (e.g. for training courses or so-called townhall meetings in large companies).
  In market research, it is common to record the interpretation in order to be able to evaluate the respondents' answers in the weeks following the individual or group interviews.
  Sometimes there is simply a desire to archive the content of an event.
• Streaming: Streaming allows people all over the world to participate in the event, regardless of their physical location. This can increase the reach enormously.
  Streaming also enables people with limited mobility or other physical limitations to attend events that they would otherwise not be able to attend.
  Streaming can reduce the costs of travel, accommodation and meals normally associated with attending international events.
